The Truth Comes Oozing Out

LBAC is coming apart at the seams and Wesley Moore was forced to resign. Here's two links to the stories but the commentaries are the most interesting part! The fight goes on!

Read the initial story here:
Here is the latest update story:

Kudos to Heather Reger for breaking this story wide open. Let's hope Christine Cuhlno will have the courage to tell-all about how she was pressured in the Noah's Ark case by Quigley.

There's also interesting information over at The Press Telegram:

The LongBeachReport (or LBReport) is asking some good thorny questions too: report and editorial . We hope Mr. Pearl gets the documentation he's requesting. The LBReport was always moderately supportive of Noah's Ark and of Alex and Gloria, maybe now they'll sink their teeth into the real story.

We encourage all of you to post on the comment sections and write letters to the editors and to the Mayor and City Council. It's time for the general public to understand that the truth that is oozing out now is the same thing Alex and Gloria were about to expose. Both women are paying a high price for taking a stand and now they need to absolved of the crimes they didn't commit.

Alex and Gloria have appeals in the works and another case is underway against LBAC itself. The wheels turn too slowly for our liking, but they do turn.

The Committee also wants to add that the Mayor and the Councilwoman from District 2 who treated those testifying at the City Council meetings like they were trash should now be ashamed of themselves. A large percentage of the animals killed by LBAC since the August 2006 raid did not need to die if the Mayor and City Council hadn't been asleep at the wheel. Shame on you public representatives -- you're as much to blame as Quigley!

Remember All The Stuff We Said Would Come Out At The Trial?

Well judge Jesse Rodriguez did everything in his power to keep that information from coming to light. But now that the trial for Alex and Gloria is over...those FACTS can be released to the public and the media.

On Thursday, January 31st, we invite everyone to the Long Beach Courthouse. On the 8:30 AM docket for judge Rodriguez's courtroom is the restitution hearing being brought forth by LBAC and the city of Long Beach. They want Alex and Gloria to pay $90,000+ for the animals they seized. (more about that in a moment) Todd Krauss will have a big announcement for everyone and we encourage you to come down to the courthouse and hear for yourself! New legal action is afoot, new opportunities for you to demand changes at LBAC.

As background here's some info that will be buried at the hearing on Thursday:

We hate to be nitpicky but here are some important FACTS they're hoping you'll forget (and TRUST -- we know judge Rodriguez will have his tighty whities so bound up over this -- that it will never come out in his courtroom)

1. Within days of the raid, Ed Boks of LA Animal Services offered to house ALL the animals free of charge at a facility that he was preparing to open. Additionally Dr. Saleh offered to provide FREE veterinary care for all the animals. Wesley Moore, head of Long Beach Animal Control (you notice the different "aura" in titles between Long Beach and Los Angeles) said to the Noah's Ark Attorney... and we quote:"Go fuck yourself! We'll see you in court." So -- the city never needed to take on this expense, they had other options that would have been better for the animals and better for the situation -- but since they were so hungry to kill all these animals, they decided to keep them.

2. After three months of holding the animals, LBAC made them available for adoption. Sounds good doesn't it! Well that's a half-truth really! People had to demand to see NA animals and those "nice SPCA volunteers" did everything they could to steer families and potential adopters away from Noah's Ark's animals.

3. And don't forget, even though they painted Alex and Gloria as these horrible hoarders (eh-hem...they adopted out 2,400 animals in one year...they really SUCK at hoarding), if they had walked in with a big fat check anytime before the animals became available -- they would have all been returned to Noah's Ark!

4. And while we're traveling in the wayback machine...don't forget that Quigley declared that no rescue who had ever worked with Noah's Ark could pull "our" animals and find them homes or fosters. Sounds bent but okay, right? Yeah, that's another half truth. One of the armchair rescuers who repeatedly dumped sick animals at Noah's Ark and NEVER contributed any money to their vet bills was Ms.Pnina Gerston. Pnina frequently dealt with Noah's Ark and on the day of the seizure had 12 dogs at Noah's Ark. In fact, Alex was convicted of animal neglect regarding one of Pnina's dogs and is in prison right now because of it. Pnina neglected to testify that the dog was critically ill when it came to Noah's Ark, that Noah's Ark had paid extensive vet fees for little Maggie, and that she was on the mend when she was seized. Maggie died after she was in Quigley's care for 3 months and Pnina even went so far as to spread lies that Maggie was pregnant by an un-neutered pit bull from Noah's Ark. All of it -- pregnant, lack of care, puppies about to be born, Pnina's relationship with Noah's Ark (or no relationship as she must have convinced Quigley) ONE BIG FAT LIE! Way to go all star rescuer!! You and Quigley are cut from the same cloth! Pnina became the person to decide which rescues got to pull animals -- uh wait a second how's that fit with Quigley's EDICT? Yeah, we wonder how much of her soul Pnina sold to the devil too! And because Pnina and Quigley were such ego maniacs HUNGERING for the media spotlight with their good deeds - they couldn't be bothered to read any of the animal's files nor ask questions about them that would get them properly homed -- so we've been quietly undoing the messes that Pnina's great rescuing abilities created!

5. For weeks, Councilman Gary DeLong and even the Mayor demanded that we be given and "inventory" of what was seized -- we wanted a list of our animals. Assistant City Attorney Krystil Myers stalled at every turn. When we were finally provided a list, there were 12 numbered lines (each animal had a line) that had nothing on them. Yet Wesley Moore and Lt. Quigley were crying crocodile tears for the cameras and telling everyone that 5 animals had died or been put to sleep and we couldn't locate many of the animals (which we have now found out they killed.) Hmmmm---somebody needs to go back to math class! We're sure Todd Krauss is reviewing the restitution "bill" with a fine tooth comb because you KNOW it's packed with lies!

6. And finally, we have many clear cases of how LBAC's subpar care resulted in extensive problems for the animals. Fraggle's feet had such bad chemical burns on his paws(which his new vet had estimated having occured within just 10 days of his adoption -- which remember was after 3 months with LBAC)that he could barely walk on his feet! Shouldn't LBAC being paying THOSE vet bills??? Welcome to Orwellian Long Beach where it's 1984 made real!

So join us on Thursday at the Long Beach Courthouse and learn about the next steps Alex and Gloria are taking and the new opportunities for you to get involved -- and make Long Beach a safe place for animals. 8:30 AM is when court begins! Look forward to seein' y'all there!

It Ain't Over 'Til The Big Dog Says So

First -- we want to make it clear for everyone who reads our blog -- this is our opinion of what we are seeing. This is not sanctioned by Alex, Gloria or their attorney Todd Krauss. These are our opinions as supporters. Welcome to America, where you still have right to have opinions and express them.

Okay--so on to the meaty stuff that you come here to read about.

The trial is now over and we begin the next stage of the fight. We knew that in a town as corrupt as Long Beach, California that we could not get a fair trial for Alex and Gloria. 13 felony charges and a quarter of million in bail??? Come on, Michael Vick was electrocuting dogs, drowning them and strangling them for fun and he wasn't as vilified! Mike Huckabee's son was hanging and shooting dogs with mange and Mitt Romney was cruising the highways with his dog strapped to the roof of his car -- and people are considering voting for them for president.

For those of us at the trial -- or rather the sidebar with an audience -- we were left totally perplexed by the judge. He truly should be ashamed as a representative of the legal system. In our opinion, he was not only crazy but clearly had accepted some sort of bribe. Even the prosecutor was shocked by the judge's behavior! The prosecutor was even more chagrinned that the judge decided to try the case for him -- give the guy a break!!! It was embarrassing to see the judge emasculate the poor guy over and over again. Even stranger was to have the judge sustain an objection when none had been raised. Wow! Suffice to say, the judge was not stellar! Too bad Judge Lord wimped out on trying the case, he at least had a shred of integrity. He'll probably leave Long Beach soon because you can't work in Long Beach if you can still look yourself in the mirror in the morning.

We all felt badly for the jury. Clearly the judge was doing every thing he could to keep the truth of obstruction and intimidation from coming out. They must have wondered when witnesses took the stand, barely got their name out and then the judge stopped them from testifying. For those of us who knew what those witnesses were about to testify to, we were truly stunned that the judge was in such a lather. The jury certainly got their exercise being removed from the court room over and over again!

Most of you also missed Lt. Quigley's strange little demonic dance in the court hallways. Dance now strange little woman, your jig will be short-lived. We won't get started on all the things that are hinkey about Quigley -- the press will share that with y'all soon enough.

Many of you have written to ask what's next? Is this it?

HARDLY!

We bided our time through the trial to ensure that we could not do anything that would be fuel for the judge's fire. Trial's over!! Coming soon -- the truth about Long Beach Animal Control uncensored so you all can see what a ruthless animal killer Quigley is. As they say in the movies, "There Will Be Blood"... our goal is for Lt. Quigley to lose her job and never be allowed near another animal again.

If you're interested in helping out in the next phase -- let us know!

It's Time To Go For It

The trial date is finally upon us and we all could not be MORE excited!

Yes, you read that correctly -- EXCITED!

There is so much that will come out in this trial and so much that will finally be exposed that we have been waiting for all of you to see and know what we have -- that yes, we are truly excited.

The trial will be held at the Long Beach courthouse on Ocean. We are awaiting the assigment of a courtroom and the selection of a jury. Then the FUN will begin. We encourage you all to join us in the courtroom if you have time. If you are stuck working and can't get there -- look for updates here. You can also send an email to lbac_justice@yahoo.com and ask to be put on the email update list.

Some rules about being at court:
  • Dress appropriately and professionally
  • No cellphones in the courtroom
  • No talking, no gasping, no shaking your head while Quigley lies over and over.

Sorry...that's just the rules.

Alex and Gloria have stayed strong to fight this battle because of people like you that show support. Sadly, LBAC has used this whole thing to try to divide the rescue community and many have fallen for it. Those of you who haven't -- thank you so much! You know, we all could have easily rolled over (like the city of Long Beach was expecting) but from the start we knew the truth and Alex & Gloria made it very clear -- no plea, no settle out of court, no giving up. If you were facing 13 felony counts, could you have been so brave to risk it all? If you knew what Long Beach and Lt. Quigley have been up to -- and you love animals -- you too would have stuck to your guns.

It's a good time to show your commitment to animals! Join us for the trial, see for yourself! And don't waste your time reading LBAC's press releases printed verbatim as news in The Press Telegram. Find out how it goes from a real source if you can't be there!

Thanks for staying strong and weathering the storm. Justice for the animals Quigley has killed from Noah's Ark and that were in her "care" for years is at hand. We did it all for them, we hope you will too!

Due to Technical Difficulties

We had some technical difficulties with our blogspot when Blogger upgraded their service. Consequently we were not able to post for a while. It's all better now though....so
THIS IS THE PLACE TO GET YOUR UPDATES!

Update from Todd Krauss:
Below please read the letter from Todd Krauss, attorney for Alex and Gloria. Please note that since this letter began circulating, we have had very heartening responses from people who want to testify on their behalf and people who have had their own nightmare stories with LBAC. There is strength in numbers -- so if you need to lean on someone for courage to right the wrongs of LBAC with your pets, we're here for you. HELP US make the change in Long Beach that is long overdue.

Court Dates:
We were scheduled to begin the jury trial on July 11th. However, Lt. Quigley would like to take her vacation time. Therefore we are scheduled to be at the Long Beach courts to begin this trial on July 18 or 19 or 20. Why so vague? They don't have a court room for the case just yet. If they cannot find one by the 20th, the city must dismiss the charges. We WANT them to find us a room! We are passionate about you all getting to hear the real story and see the real evidence -- not the continued poor journalistic blabber in the Long Beach Press Telegram. (We'd like to nominate Wendy Thomas Russell for a Razzie if they exist for journalists!)

Between Now and Then:
We are working to organize a town-hall style meeting for everyone. So many of you have stuck with this case through thick and thin; we want to give you an overview of what is going on, what you can do to help, and why we are continuing to fight (when the easiest path is just to roll over -- guess we're just obedience school dropouts, we never learned that trick!)

Please understand though -- there are many aspects of this case which cannot be discussed until they are presented in court. We will do the best we can for you though. Information about the meeting will be posted here. For our supporters in other states and countries, we'll post information on the blog after the meeting for you ... and any highlights too.

It's good to be back! Hope you enjoy the rollercoaster ride, it's definitely an E-ticket -- and thanks for hanging in there with us!

Update from Attorney Todd Krauss

Many of you have had questions about the on-going criminal case filed against Alex and Gloria of Noah's Ark. As their attorney, I thought it would be helpful for all of you to receive an update.

First, let me thank you for your patience. For many of you, I am sure it seems like the wheels of justice are turning slowly; but, we have actually been able to move this case along fairly quickly. This is a very large case with many extenuating factors and our preparations have been ongoing since day one and continue today. However, I must say that after having seen all the evidence from the City of Long Beach, I am happy to represent Alex and Gloria because it is quite obvious that this case is one largely of retaliation and has no merit in my opinion. This case was designed to keep Alex and Gloria QUIET; but unfortunately for those who wanted to silence them, it will produce just the opposite affect.

I also know that many of you are concerned about the animals that were seized. According to the information released from Long Beach Animal Control (LBAC), all of the dogs who were seized but not euthanized have been adopted. It is our understanding that about a third of the cats are still being held and many continue to get upper respiratory infections while in LBAC's care. Many of you have worked quietly in the background to facilitate adoptions and transport for the animals, and others of you have worked to keep the media's and community's attention on the animals. All of your efforts have been very instrumental in keeping LBAC from killing off Noah's Ark's animals.
In my own opinion, making these animals suffer for LBAC's personal vendetta is the most despicable aspect of this whole saga. As a fellow animal lover, helping to clear the name of two women who have been such advocates for animals in the southland and the ability, in some measure, to give voice to the animals is a part of the reason I am dedicated to this case.

In the coming weeks, I anticipate that the court room will become quite animated. I encourage any of you who have the time to join us to show your support and to share in the shocking information I will be revealing. It's easy to be a Monday morning armchair quarterback; but the time for change is now and it is up to ALL OF US to the affect change in the City of Long Beach, and that requires all of us to courageously step up NOW to demand change. If you have been threatened, harassed or pressured to give up an animal please contact us immediately. You may very well testify at court and help bring the change we all desire.

I am confident that we will win this case. However, I want to do more than win, I want to be able to affect some real change within the Long Beach Animal Control's methods and practices. I can only achieve that goal if people are willing to come forward and speak the truth about what is going on. The time is now.

The prosecutor for the Los Angeles County District Attorney's Office (the DA's office prosecutes felonies, the City Attorney prosecutes misdemeanor cases) has also tried repeatedly to force Alex and Gloria to have two attorneys. It is their Constitutional right not to do this; and, they have chosen to be represented only by me. It was District Attorney's intention to pit Alex & Gloria against each other; but not only did it not work, it further strengthened their resolve and determination in this case.

Alex and Gloria's case will be heard by a jury. The court asked if there was ANY WAY to resolve this case, and the answer was a RESOUNDING NO. Even if they were offered a plea, neither of them would accept one. As an attorney, I would advise my clients what is in their best interest, and in this case, I whole-heartedly agree with them. Neither of these women is guilty of ANYTHING except loving and caring for animals. I do not know many people who would be brave enough to risk everything they have because they believe so much that Animal Control needs to clean house and that the City of Long Beach is overdue for animal reforms.

I cannot tell you about much of the evidence right now; we must save that for the trial. I can tell you based on testimony from the preliminary hearings that at the most basic level, the city has serious problems with their case. Testimony from the prosecutions witnesses has been wildly conflicting.

I can also tell you that I anticipate many gasps in the courtroom as we present our case. Thus far, you have really only heard what Long Beach Animal Control and the Long Beach City Attorney have wanted you to hear – and they have painted a very skewed picture. Photos taken at just the right angle, horrendous statements to the press by people who later testified they had no prior knowledge of nor had ever visited Noah's Ark, testimony that was muddled and confused at best – these have been the weak foundation upon which the city has built their case.

I urge you to be at court as much as possible to learn the full truth. Once you have seen the WHOLE picture, as I have, you will also know that Alex and Gloria are innocent. The Noah's Ark Justice Committee will post the court schedule on their blog at
http://najustice.blogspot.com .

It has also come to my attention that people have been contacted by LBAC without that being disclosure to us in the discovery phase , which is improper. I am hearing that others have been intimidated regarding this case, and still many more have endured what they believe to be illegal seizure of their former Noah's Ark pets by animal control officials. I also understand that many in this community have had difficulties -- to put it mildly -- with Long Beach Animal Control. Coming forward with the truth may seem daunting and risky. But rest assured, none of this is proper especially when it comes to this case and it's time for this frontier mentality to end.

I have set up a special email address for people to notify me if they were contacted by LBAC and were coerced or threatened to elicit their testimony in any way. Please contact me via email at:
tkrauss.atty@gmail.com. For those of you who have had difficulties outside of this case with Long Beach Animal Control, please contact the Noah's Ark Animal Justice Committee at their email address: lbac_justice@yahoo.com

The time for action is now. I know it has been a difficult getting to this point and many of you have been filled with doubts because we have been unable to share with you so much of the underlying evidence of this case. From what I have seen, it is time for a change in the way animals are cared for and managed in the City of Long Beach. If you want to see that change, it's time to step up now.

Again, my thanks for your patience as we take this case to trial and I hope to see you all at the Long Beach Courthouse. Further, I look forward to celebrating the truth of this case with you all as it is revealed.
Sincerely,
Todd Krauss, Esq.

Things That Make You Say Hmmmmmmm

On March 29, a sealed deposition was supposed to take place at the Long Beach court house with Dr. Saleh, formerly the city and Noah's Ark's veterinarian. The District Attorney spent over an hour protesting Dr. Saleh's deposition, doing everything she could to keep him off the stand; and, a session that was supposed to be closed was open to the press (if you can call The Press Telegram "press"). Typical MO for this corrupt city!

Now, Dr. Saleh was the "state certified" veterinarian that Lt. Quigley claims told her to seize the animals. There's a little problem with the city's "evidence" here -- 1) Dr. Saleh was not present at the site on August 23, and 2) Lt. Quigley asked him about the smell of bleach, not urine, as being the reason to pull the animals out of NA's facility.

There's much more in the way of testimony this brave doctor and wonderful veterinarian can offer that sheds light on how out of control Long Beach Animal Control is -- but just based on these two little "problems" in the city's case -- you can well-imagine that they don't want the good doctor anywhere near the stand nor giving public testimony that might expose LBAC not only in court but in their beloved media.

Why did the city fight so hard to keep their former "star" witness to the alleged horrible conditions at Noah's Ark from testifying? Don't scratch your head too long --- It's because they know their lies will be exposed and that this man has so much more information that can become their undoing!

Not to worry -- Dr. Saleh will take the stand in the near future! We'll keep you posted!

March 30 Update

March 29 was the beginning of preliminary hearings for Alex and Gloria regarding Noah’s Ark. Basically the city presents the “evidence” they are basing their charges on and then the judge decides whether the case merits the time and expense of the court to move forward. Alex and Gloria, as represented by their attorney, have the right to cross examine any witness the city puts up.

The City’s Star Witness
Come See Her Next Dramatic Performance
(maybe there will be an interpretative dance added!)

The City of Long Beach only had one witness: Lt. Michelle S. Quigley. The DA was over an hour late (as usual – her time is SOOOO much more valuable than any of ours) and then other cases popped into the court in the middle of our hearing -- so we did not get to the point of cross examination in the preliminary and no decision has been made yet.

The case was continued to next Thursday – April 5 at 9:30 AM in room 24 at the courthouse. (Take a break from doing your tax returns and join us at the Long Beach Court House – then you can see what your tax dollars are funding!)

We anticipate that the judge will say that the case does merit a trial -- and we're a-okay with that! A jury trial will allow Lt. Quigley to show her real stripes and her working-with-the-media training – she’ll probably cry a whole bunch more especially if there are cameras there. Pnina Gerston and Glenn Pendergast will be called to testify and you’ll see what kind of truly IN-credible witnesses the City of Long Beach has chosen to use. Alex, Gloria and The Noah’s Ark Animal Justice Committee look forward to trial so you all can find out why we believe what an insane, incestuous, animal-hating, corrupt city Long Beach is.

Quigley Brought to Tears???
Yep – CROCODILE Tears!!!!
Quigley turned on the waterworks at the end of the March 29 hearing -- it was so rehearsed even the judge was confused by it. The cat she was describing on the witness stand was a feral (and we all know how much Quigley hates ferals!!!) that was so sick, it had been scheduled for euthanization by Noah’s Ark on the day of the raid. Long Beach Animal Control – who didn’t bother to ask about medical records when Quigley admitted Gloria was there the WHOLE time – decided to prolong this cat’s agony by keeping it alive for days longer. This poor feral cat was sick and dehydrated when it was dropped at Noah’s Ark. A state-licensed veterinarian consulted on the kitty’s condition; and Noah’s Ark & the vet knew it was cruel to keep this kitty in its misery. LBAC was not so kind. The story of LBAC and their vet deciding to shave this cat belies the fact that this cat was being kept alive without good cause and that shaving such a sick kitty was cruel beyond measure – but they did it anyway. This “story” was when Lt. Quigley “broke down” on the stand – and well she should, she should be ashamed of what she did on many levels.

The Press Telegram Keeps
The City Happy -- Again!
Of course, due to the way the process of a hearing works – the Press Telegram only printed what it could – Lt. Quigley’s twisted, taken-out-of-context, and often MADE UP testimony. Cross will be far more interesting. Too bad the Press Telegram didn’t bother to go back and read its own reporting on this case – the examples of her ever-changing story were many!

Animals in a Freezer –
The REAL Story
the Press Telegram Wouldn’t Report
The District Attorney also is trying to make a BIG deal about animals being in a commercial freezer wrapped in plastic bags. For any who do not know – and of course the Press Telegram couldn’t be bothered to do some investigative reporting...oh it’s sooooo hard! --- when animals pass, any facility (be it a rescue, a pet store, a veterinarian or LBAC) is required BY STATE LAW to store the animal in a freezer wrapped in plastic until it can be cremated and it’s remains returned OR picked up and sent to a rendering plant to become cat and dog kibble. When you have your pet put to sleep at a vet’s office – this is what your vet does. This is what Long Beach Animal Control does with the thousands of healthy, happy animals they kill every year. A company will then come to your facility to pick up the frozen remains from your commercial freezer (your little home refrigerator doesn’t really meet state code!) What no one OTHER than Long Beach Animal Control does is take them out of those bags and poses their frozen bodies on the pavement – that takes a special kind of perversion.

It’s SHOCKING – NOT!
Lt. Quigley also testified that Noah’s Ark had the audacity to put poop and pine shavings in their commercial dumpster along with the mop water they sucked up with a commercial shop-vac (and put into mop buckets) so it didn’t go into drains that drain to the ocean. Imagine!!!! Putting poop in a dumpster!!!! Those Noah’s Ark people are INSANE to actually dispose of poop in the proper manner. Good thing they took photos and have now presented them as evidence.

An Invitation
You can see just from what we’ve talked about here that this case is one that will make you shake your head in disbelief – the city’s conniving is baffling! Come join us for the next ‘installment” on April 5 at 9:30 AM! See it for yourself, because trust us – no one will ever believe you!

The Next Step!

Many people are asking, "What's up with the cases?!" So -- here's a quick update!

The case for the animals continues to work it's way through the red tape of city government. The charges against Alex and Gloria are finally coming to head -- with a court date on March 29 at the Long Beach Court House on the Third Floor. Please, please, please attend if you are able. We anticipate that other dissenting parties will try to fill the courtroom and force the Noah's Ark supporters to have sit outside the courtroom in the hallway. Court begins at 8:30 AM, so please try to be there early to secure a seat for yourself in the courtroom. The baliff will also ask that there be no cellphones on, no chewing gum and no hats in the courtroom.

This hearing is to determine if we go to trial; we anticipate that the case will be held over for trial. We anticipate that the Long Beach Press Telegram, which in our opinion has been shamefully lacking in their journalistic integrity and is being little more than just a mouthpiece for Lt. Quigley, will try to paint "being held over" as just proof positive that Alex and Gloria are guilty. This is not the truth!

In the face of so much pressure and such great expense, some people might just roll over and cave in at this point! Alex and Gloria continue to be very brave and are willing to take this case to a jury trial so that Long Beach Animal Control may be exposed for their abusive tactics with animals and people. It is worth the fight because it is time for the system to change!

You may, or may not, have seen some of the recent headlines in The Press Telegram -- "Alex is a hoarder" as accused by Jennifer Pryor and The Barbi Twins, which was met with many inquiries about how one could be defined as a hoarder when Alex and Gloria adopted out 2400 pets in one year alone. Lt. Quigley continues to protest that there is no way this could be done. In truth, it's done by the rescue community WORKING TOGETHER, a quality Noah's Ark was repeatedly praised for by other rescues of integrity. After the Press Telegram had egg on their face with that headline, they went on to claim in the next day's paper that Alex and Gloria were illegal breeders. Had we really cared what this irresponsible rag continues to mislead people with -- we could have presented the thousands of dollars of vet bills for spaying and neutering -- it's just not worth the effort since The Press Telegram rarely comes back to admit they are wrong or slanderous. So in the end, Alex and Gloria are not very good at hoarding (you need to hold on to the animals to be a hoarder), and they are also really bad at breeding (you need functional "hardware" for animals to breed) -- which is all to say -- Don't Believe Much You Read in The Long Beach Press Telegram!

In the last few court house "meetings", the prosecutor tried to say that Noah's Ark supporters are creating a climate of fear for the witnesses. After a discussion in chambers, the judge returned to say that he did not believe Alex or Gloria or those supportive of them were creating a climate of fear - however he did note that animal cases bring volatile emotions out of people. We have said from the beginning, this case is not a case that needs to be tried in the media -- it needs to be tried in a court of law. We have continued to support a non-violent approach and we know all of you do too. But in the meantime, we are posting the following as a formal statement.

We look forward to seeing you on the 29th!

Noah’s Ark Justice Committee does not engage in or condone any acts of vandalism, violence or verbal intimidation in any form. Our goals are to secure the release of the Noah’s Ark animals confiscated by Long Beach Animal Control, and to work through the legal system for justice for shelter volunteers arrested on bogus charges of animal cruelty.

Acts of violence or destruction of property only serve to harm any cause and ours is no exception. Our success will be
achieved by working through the judicial system.

Join Others Who KNOW

The truth is coming out and the media is finally started notice as well as other rescue groups who are helping to remind people that our animals are growing depressed.

Read the latest story in The Gazette.

See our animals on the Best Friends web site. However, please note that the names being used for our animals are not the names we use -- they have been renamed by Ms. Gerston. Also some of the animals shown do not belong to Noah's Ark -- but we still encourage you to adopt them!

If you, like so many others, are outraged by this whole situation, please join with us by signing our petition. Let Long Beach's elected officials, the local media, and the public know where you stand on this issue. The Petition

We were also notified by the animals' attorney that a response has come back from the City of Long Beach regarding our protest of the seizure. We will need to raise additional funds for their attorney, Michael Rotsten, as we show that the hearing was conducted improperly. You can donate to their cause via the PayPal link on the Noah's Ark web site.

As always, we thank you for continuing to care. We thank the many of you who have been so generous with monetary support. It's time for these animals to have homes, if you have thought about opening your home and your heart to a new canine or feline family member -- please, consider one our awesome animals!

We're holding a fundraiser -- selling off collectibles, videos etc. on Saturday and Sunday (this weekend) at 2741 East 4th Street in Long Beach.

Of special interest to our animal supporting friends -- we have quite a bit of Advantage to sell -- so if you need to get ready for flea season -- and who doesn't??? -- stop on by.

If you don't need anything and just want to help out -- boy we could use any kinds of donations -- even $5 or $10 makes a difference. You can use PayPal on the Noah's Ark site -- www.n-a-a-r.com or www.noahsarkanimalrescue.com . Thanks!

And Now THE REAL FIGHT Begins

We've been a little slow in posting information here for a variety of reasons. We'd like to have our attornies (all of them) review information before we post it.

Here's what we know we can say right now:

FIRST -- all of you are amazing and we are grateful for EVERY effort you've made and continue to make for the animals. We are still waiting for the city's response to the writ -- not surprising that they're dragging their heels. [more below]

Your continued phone calls and emails are very powerful. Now that we have some of the court documents from Alex and Gloria's cases -- we've been able to find out the fate of some of our animals and it is nauseating. We continue to say -- IF there had been a problem AND the city's true concern was for the animals (which after what we've read about what they did to some of them that could hardly be the case) THEN a 10-day notice to comply would have been Wesley Moore and Lt. Quigley's obvious choice to remedy the situation. This simple fact cannot be yelled from every rooftop loudly enough. The Mayor NEEDS to be held accountable for his lack of response to this situation. Please let him know your feelings: mayor@longbeach.gov

We are preparing the case files for Alex and Gloria's cases and helping in any way that we can. The cost of this case is enormous but TOTALLY worth it. However both women could use any financial help you have to offer. This case will cost $35,000 minimum. You may contact their attornies at Williamson & Krauss at 18801 Ventura Boulevard, Suite 206, Tarzana, CA 91356,(818)344-4000 to help. Any donation helps, it all adds up!

The city has yet to respond to the civil suit filed on behalf of the 4 volunteers who were subjected to excessive use of force at the raid. The city needs to explain why a 12-year old boy watching the police needed to be tasered. The city needs to explain why two other teenage volunteers needed to have their arms wishboned behind them. And, the city needs to explain how a 69-year old woman posed such a threat that she needed to be put face-down, spread-eagle on the pavement and refused access to her medication for four hours.

The city will need to respond to the writ filed on behalf of the animals soon. Michael Rotsten will be representing the animals and is now the attorney of standing/record for the animals. Again, your emails and letters to Wesley Moore (wesley.moore@longbeach.gov) about this kangaroo court (an animal control official decides if Animal Control's seizure was legal -- strike anyone else as a bit ridiculous?) and the total lack of concern for the animals is helpful. Mr. Moore needs to know that you are watching THIS case as well and that the animals have served their political purpose in his game -- they had after a meer 2 days when Ed Boks of LA Animal Services offered to house all of them at no cost to the City of Long Beach and keep them safe from Quigley's needle of death. Mr. Moore's style of animal control is unacceptable in our modern-day society...we might have ignored it in medieval times -- it is NOT ACCEPTABLE in California today. We could also use your help defraying Mr. Rotsten's fees to combat the shoddy work of the city of Long Beach. Tax deductible donations may be made through Noah's Ark's web site to the animals' defense fund via PayPal. You can also make non-tax deductible donations directly to Mr. Rotsten at 16133 Ventura Boulevard, Suite 700, Encino, CA 91436. Due to Mr. Rotsten's many animal rights cases, he is unable to take phone calls right now.

We feel very lucky to have all of our attornies at our sides -- they are all highly skilled gentlemen.

Thank you again for the vital part you are all playing in this demand for justice. It's our hope that we will see some sort of reform in Long Beach as the result of these cases and that they will help put all archaic animal control agencies on notice that their backward and out-of-step policies are no longer viable. Our greatest hope is that the results of our cases can be used as precedents for other rescues in California. We KNOW other rescues will encounter the same underhanded, vendetta that Noah's Ark has been subjected to; we hope this will be of help to them.

Have we reached the tipping point yet in California? Hardly. Are we on the path to reform? Yes. Can you make a difference? You betcha!

It Wasn't Pretty

At today's arraignment, Gloria and Alex were both charged AND the District Attorney asked for $260,000 bail for each of them. The judge presiding felt that a quarter of a million dollars was excessive and dropped it to $100,000. We are raising bail right now. We need $10,000 each and collateral valued at $100,000 for the bonds person.

Additionally, starting legal fees are $35,000. Have you caught on to LBAC's plan yet?? You guessed it! They hope to break us financially so we have to drop the case.

Every day we receive generous donations from people like you -- we are able to fight this fight on behalf of rescues large and small who give their service to animals. We are hoping we can set a precedent with Noah's Ark that will benefit all rescues in California.

But in the meantime -- we need your help!!!
Donations can be made through the Noah's Ark web site for the animals, or to Williamson & Krauss for Alex and Gloria (18801 Ventura Boulevard, Suite 206, Tarzana, CA 91356)

Mark your calendars for January 4th at 8:30 AM in Dept. 56 of the Long Beach Court.

It's GO Time!

Thanks for stopping into the Noah's Ark Animal Justice Committee's blog. We encourage you to scroll down to read about this case and we hope you'll visit frequently to stay updated on the latest happenings.

WE NEED YOUR HELP on several fronts.

December 21 at 1:30 PM
Please use that sick day at work or whatever you need to do to join us at court on December 21st. We will be at the Long Beach Court at 415 Ocean Avenue in Long Beach. Court is set for 1:30 PM. They will probably try to change the venue at about 1:20 PM hoping you will all cave in and figure it's not worth the effort. DON'T Fall for this tactic! This court date is when Alex and Gloria will each be charged with 13 felonies and 2 misdemeanors. This is LUDICROUS! We also anticipate the media will be there. Please join us to show your support for the animals of Noah's Ark -- they are being used as political pawns in this vendetta by Long Beach Animal Control.

December 14
We filed a writ of appeal today against the seizure by Long Beach Animal Control. Previously an animal control staff person acted as "judge" to determine if the seizure was legal. How's that for the fox guarding the hen house?! WE NEED YOUR FINANCIAL HELP -- any donation of any size is huge to us. You can send a donation directly to our Attorney, Mr. Michael Rotsten 16133 Ventura Boulevard, Suite 700, Encino, CA 91436 (818) 789-0256 OR if you want your donation to be tax deductible -- you can donate through PayPal on the www.noahsarkanimalrescue.com site. To be clear, PayPal donations go to a bank account that can only be used for Noah's Ark's animals. $5/$10/$15 donations add up quickly. Our legal fees are $5,000 already. We'll keep you posted on the status of the writ here.

TODAY AND EVERYDAY
The one thing that has forced Long Beach Animal Control to toe the line and kept the Mayor from just brushing this under the rug is the constant attention from people like you! Emails, phone calls, letters that tell city officials that treating rescues this way is unacceptable, that Noah's Ark should have been given a 10-day notice to comply, and that you will encourage others not to shop, dine, or do anything that might result in revenue for the city. Public outcry has made a difference!

If you are a 501C-3 rescue and have space for a cat or dog, please consider rescuing one of ours. Rescues are being given a preferrential rate on our animals of $25 for dogs, $17 for cats. Pets over 6 have a $10 discount. You will also have to pay for a spay or neuter -- please note the majority of our pets were fixed. There were no un-neutered adult male dogs or cats at the facility. Animal Control forced one adopter to spay a dog that had already been spayed -- this was a family adopting the dog! We encourage you to stand your ground if LBAC attempts to deny you an animal. Feel free to contact Sean Petersen in the Mayor's office if you are given grief or the runaround.

THANK YOU
LBAC was hoping to outlast your attention span, they were hoping to divide and conquer the rescue community, and they have been trying to use the media to spin their story. Thank you for seeing through the games. Thank you for continuing to care. Thank you most of all for putting the respect of animals high on your list.

Please, join in the fight in any way you can!

Protect Our Civil Liberties

Please read this important story of corruption and the disregard of animal rights in Connecticut: http://www.geocities.com/stop_corruption_now/please_help_us.html

We are close to our goal

We have raised $3200 for the animal rights attorney, Michael Rotsten. We need to deliver the rest of the funds to Mr. Rotsten before noon tomorrow -- that's just $300 more. Any size contribution can make a difference.

Mr. Rotsten will file an appeal against the illegal seizure of our animals if we can get him the funds he needs to file the case and cover his time.

$10, $25 -- everything can make a big difference right now!

You can donate through the Noah's Ark Animal Rescue web site if you want your donation to be tax deductible or directly to Mr. Rotsten:

www.noahsarkanimalrescue.com
or Mr. Michael Rotsten -- (818) 789-0256

Help us make this goal and get this case in front of a judge (not a kangaroo court called an Animal Control Administrative Hearing) -- our animals are depending on you!

It's Not Just Us -- Long Beach is Under the National Eye

While many would like to paint Noah's Ark supporters and Alex/Gloria as despicable and crazy -- don't buy the spin, in truth we are anything but! Media spin by animal control agencies and apathy on the part of city government seems to reign not only in Long Beach but in communities around the country. And now -- others are helping us to spotlight this case as yet another demonstration of the ruthless efforts of people like Lt. Quigley and Wesly Moore go unchecked.

Change only comes from citizens in this country saying enough is enough when it comes to entrenched, bureaucratic bodies who abuse their position and power. Have you had enough yet?

We are not alone in our efforts to change and reform the sad state of animal rights. Meet another rescuer in CT whose plight is not much different than ours. We have been included in the web site about her efforts to expose the truth of animal control practices and abuses as a demonstration of unity, as another place to bring more awareness to what's happening in Long Beach. Rescuers across the country are under fire as people gain the knowledge of what their tax dollars are being used for -- much to their growing horror.

For any rescuer to attack another in this climate is sad -- it is time for unity. As we continue to fight, we stand arm in arm with other rescuers who are fighting the fight. Think globally, act locally!

Adoption Event - A Sad Reality

On Saturday, December 4, 2006 SPCLA in Long Beach, California held an adoption event. One of the advertised goals was to show, and ideally find homes for some of the seized Noah's Ark pets. The Noah's Ark dogs and cats were recognizable by the yellow ribbon placed on their cage. Unfortunately, virtually all of the animals with such a ribbon were not in fact from Noah's Ark. Noah's Ark representatives were on hand to view all the prospective adoptees and found just a single dog that was properly designated.

Tragically, many animals continue to languish in cages at the Bureau of Animal Control. Many are in very poor health. For no apparent reason countless animals remain in these cages and are not made available for adoption.

We believe these animals are the victims of poor management. Is this harsh criticism or reality? Look at it this way, has the city of Long Beach been given glowing reviews and awards for it's Bureau of Animal Control like other major cities like San Francisco? If the city of Long Beach's Bureau of Animal Control was so brilliantly run, would there be entire organizations and web sites devoted to pointing out potential mismanagement?

We urge you to ask your own questions.

Contact the Mayor of Long Beach, Bob Foster at 562.570.6801 or send him a note at mayor@longbeach.gov

City Approved Terrorism

Due to recent actions by Animal Control officers, we are advising people not to be at Long Beach Convention Center for a protest of Eukanuba/AKC dog show. While all of us are perfectly willing to be arrested/jailed on behalf of the animals, and we believe that Animal Control would create a false reason for arresting people, our time and energy is better spent agitating for change outside of a jail cell and with free phone access.

Animal Control officers have taken to intimidating and threatening people involved or in some cases even just interested in Noah's Ark. Many other people are afraid to speak up because they fear reprisals against themselves or their pets. They are right to be fearful. Long Beach has no review mechanism for this group of people who want to be law enforcement officers but dont' have what it takes; so, they are left bullying pet owners and innocent animals, all with the city's quiet nod of approval. This is not the kind of community any of us wants to live in. If we wanted to live in a city-funded state of terrorism, or if any of us thought that a prison-state was idyllic -- we wouldn't be Americans. And yet, the city of Long Beach struggles to cover it's growing un-American employees' actions.

We encourage all of you who were ready to go to the dog show in protest to instead call AKC and ask them to support our demand that the animals be released. We encourage you to stress that an 80% kill rate at a "no-kill shelter" makes a mockery of the demands of AKC to lift the city's breeding ban. Now AKC is part of the problem in Long Beach that results in mounds of dead animals who are needlessly killed. By holding Noah's Ark's animals hostage, LBAC contributes to the problem of needless deaths because they have no place to house other pets. Los Angeles Animal Services has asked for the animals to be released to them REPEATEDLY. They have received nothing but deafening silence from Long Beach's authorities.

LBAC has unplugged it's phones, it's fax machine and refuses to return phone calls for days on end. The City Attorney has provided us public records that are incomplete and audio tapes that are garbled and useless. They have dragged their feet to avoid supplying us the documents that are taxpayer paid-for records of hearings and court proceedings. They continue to stonewall Councilman DeLong's office at every turn.

Animal Control lead by Wesley Moore and Michelle S. Quigley have no desire to set any of the animals free or give them a chance at life; to do so only shows that they were WRONG in the extreme about these animals. It is ONLY because of constant public scrutiny through phone calls and visits, and attention from Councilman De Long's office (we wonder what happened to Mayor Foster in all of this????) that they have been unable to crank up their massive killing machine and begin the wholesale slaughter of our animals.

Is this the city you want to live in? Is this the way you want your employees (they are paid by your tax dollars) to be accountable to you? How much are you willing to put up with? How many animals must be killed in order for this city to finally do something? It's up to all of us to demand change!

Is Your Next Family Member At LBAC

Use these links to see more about Noah's Ark's animals that need to get out of LBAC. Someone at Pitchford village told a woman adopting an NA animal that all the animals in building 700 are due to be euthanized.

Only your continued attention and agitating can keep LBAC honest!

You can also click on the links section to the right for our slide roll to see a movie Alex created about the reason Noah's Ark existed. Many of the animals at LBAC are in this tender show.

Upcoming Dog Show

On December 2 the AKC/Eukanuba dog show will arrive in Long Beach, CA. The city quietly rolled back a breeding ban at the request of the show's organizers last year. So, while we fight to keep animals alive, backyard breeders can keep filling the shelters thanks to this rollback.

The powers that be at AKC and Eukanuba need to know that Long Beach is a poor choice for a national show about dogs. With a shelter that has a kill rate of over 85% and a track record for ignoring the Hayden Act and killing pets -- this is hardly the venue for a dog show. Further, it is tragic that Long Beach actively works to shut down rescues in the city limits and prefers to take animals like those seized from Noah's Ark and kill them. If Eukanuba wants to use Long Beach as a venue for their show, you might encourage them to contact the Mayor in order pressure him to bring Animal Control back under control and demonstrate this change by releasing Noah's Ark's animals!

You may want to contact the judges of the show and let them know about their host city's unfriendly animal practices:
http://www.akc.org/invitational/judges/Dec_2006_Judges.cfm

Here's a list of people in the communications department at AKC. You might want to enlighten them about their host city and how much they seem to like to kill dogs:
http://www.akc.org/press_center/communications_dept.cfm

The show will be broadcast on Discovery and Animal Planet. Here's where to contact these media venues and let them know you will actively discourage viewers from watching the show because of Long Beach's police state policies regarding animals and that you will write to the advertisers to let them know that you will not buy their products as long as the AKC show is in Long Beach UNLESS Long Beach changes it's attitude toward animals:

Los Angeles Discovery Channel Advertising Sales: Michael Weber, Vice President
Advertising Sales, Western Region
Phone: (310) 975-5921
Fax: (310) 203-8455

Los Angeles Animal Planet Advertising Sales: Ben Price, Senior Vice President
National Advertising Sales
Phone: (310) 551-1611
Fax: (310) 203-8454

Here is a list of hotels that AKC has designated for people to stay at. You might want to flyer the hotel or actively protest at these venues:
http://www.akc.org/invitational/2006/dec/travel_hotels.cfm

And, as always, you may want to send a letter to the editor about the irony of having a national dog show in Long Beach while LBAC threatens to kill Noah's Ark's animals after illegally seizing them in August. And, that it is strange that a city with a shelter that kills 8 in 10 of the animals that walk through their doors should host a Championship Dog Show.

What Next?

A person who was at LBAC today to adopt a pet called the Justice Committee frantic after her visit. A SPCA volunteer told this person that all the animals in building 700 are due to be euthanized shortly.

We have been very concerned about the animals in building 700 because this building is far off the typical visitor's path and volunteers actively discourage visitors from seeing these animals. This is the building that has a group of our dogs in an area behind a chain which visitors are prohibited from approaching. This is also the area that houses a mom dog and her babies.

We can only hope this was yet another volunteer who is ill-informed. But even the idea that a volunteer would think this is true and would further be spreading this information is deplorable.

If it is true, the good faith negotiations of Councilman DeLong are being seriously undermined. Lt. Quigley and Wesley Moore's assurances are surely then nothing but LIES!

If you are a rescue group, please help our animals now at a new lower rate. If you are a caring citizen, please call Lt. Quigley's office (562) 570-7387 and DEMAND that none of these animals be euthanized. If you are given the brush off, please voice your extreme displeasure to Mayor Bob Foster's office at Tel: (562) 570-6801 Fax: (562) 570-6538 e-mail: mayor@longbeach.gov.

The very idea of this is sickening and reprehensible!

What Is Lt. Quigley Thinking?!

Lt. Quigley arrived at the home of Gloria, one of Noah's Ark's volunteers on Tuesday. She arrived in a non-city vehicle and proceeded to block the driveway at the multi-unit housing complex where Gloria and her children live.

The Lt. then began banging on Gloria's door and demanding to be let in, yet, she had no warrant or any other official documents. Witnesses reported Lt. Quigley pounding on the front door of the home demanding to be let in. The volunteer had not requested a service call from Animal Control and due to the ferocity of the pounding on her door, was too terrified to answer the door.

One of Gloria's neighbors came outside to leave for work. Another neighbor who is wheelchair-bound was being picked up by his transport company. Lt. Quigley loudly began demanding information about Gloria and her children from them -- information of a personal nature.

The neighbor replied that he did not know the information Lt. Quigley was demanding and asked again that she move her vehicle so that he could leave for work. Lt. Quigley threatened the man saying, "Maybe you are drunk or stoned -- I might need to call the police."

The young man replied that if Lt. Quigley had been professional, he would have asked for her card and made sure it got to Gloria; but since she was so rude, he intended not to help her and again demanded she move her vehicle. With a gathering crowd of witnesses to her aberrant behavior, Lt. Quigley finally relented and drove off.

Given her history of seizing people's pets and deeming them aggressive for no apparent reason, Gloria is understandably fearful for her own pets. Also, given that Gloria's two sons have filed a civil complaint against the city, Lt. Quigley's attempt to intimidate this family is pathetic and wholly inappropriate.

If you too believe this behavior needs to be reprimanded or if you believe that Lt. Quigley needs to step down, please join us in writing to Ron Arias, head of Health Services. He is Lt. Quigley's boss' boss. You might also email the Mayor. Addresses are listed in the post here entitled Dear Mr. Mayor.

As a law-abiding group of citizens we are outraged by this lack of professionalism on behalf of the city of Long Beach and Lt. Quigley. A formal complaint was made to the Department of Health and Human Services which oversees the Bureau of Animal Control. Astonishinly, our volunteer was referred back to Animal Control and we suppose, Lt. Quigley! Is there any oversight? Is anyone in charge?

Good News from Councilman De Long

Here is the good news we have gotten from Councilman DeLong's Office. The Councilman has worked very hard to help us achieve a drastic fee reduction and we are very grateful! Please take a moment to drop his office a thank you note for their on-going assistance at district3@longbeach.gov.

Approved animal rescue groups can adopt from Long Beach Animal Control for the following fees: $17.00 per cat and $25 per dog (includes all vaccinations) plus the actual cost of altering the animal as follows:

Cat (Spay) $35.00
Dog (female) $50.00
Dog (male) $40.00

There will be a $10.00 discount given for the adoption of a "senior" animal (6+ years old).

We will also be linking to another site that has pictures and information about the animals still at LBAC. We hope this helps the rescue community to find the pets that meet their adoptee target market.

If FOR ANY REASON a rescue group is denied an animal, please contact the committee or Councilman De Long's office immediately. It is our contention that Hayden Act DENIES Long Beach Animal Control the right to pick and choose which rescues are "approved." Additionally, they have already broken the standard for choosing which rescues to work with -- we were told it would be any one affiliated with Noah's Ark. However, Pnina Gersten, who had the second most number of animals at Noah's Ark was permitted to pull three animals a few weeks ago.

Additionally, most of Noah's Ark's animals had been spayed or neutered. In many cases, we can also help you determine a pet's age since it appears LBAC staff have difficulty doing this.

Thanks for your continued support of these adorable animals all looking for families.

Potential Good News on Monday

Councilman DeLong's office contacted our representative on Friday evening to let us know that Monday should bring very good news, although we do not know the details.

It continues to be our goal to get the animals out and onward to homes either through rescues, fosters or adoptions. We are encouraged that our goal to get the fees waived for rescues that want to help the animals might actually happen. Many of you have helped lobby the Councilman to put an item on the city council agenda to do just this. We hope that the news on Monday will mean that we no longer need this agenda item.

We do know that the Mayor made an announced visit to Pitchford Village on Thursday. Sadly, we wish it had been unannounced so that he could see the true conditions there, but we are -- at the very least -- grateful that the Mayor continues to care too about the fate of the animals.

We will get you an update about the news as soon as we have it. We will post the information here.

In the meantime, we also have word from an "insider" that Lt. Quigley is showing signs of breaking under the pressure of YOUR continued attention. Some of the quotes Quigley has made to the press and information that being supplied through public documents is not adding up. Please continue to keep the bright light of your attention on the animals and their plight! Many people are complaining about the lack of responsiveness from LBAC and from Wesley Moore, you can contact Ron Arias, head of Health and Human Services, to voice your concerns (562) 570-4000.

And again, if you have had a problem with Long Beach Animal Control -- please contact us through the email address on the header. We do not believe that what happened to Noah's Ark's animals was an isolated incident. We contend that LBAC has flaggrantly disregarded the Hayden Act and Food & Agriculture codes for some time. It's time for reform! But first, let's get these animals to homes!!

Fraggle is Found! But He Barely Made It...

We are overjoyed that Fraggle has been adopted. However, the story of this dog's journey to his new home after he left Noah's Ark is a travesty. This is a dog with a very difficult medical condition. It was on a vet's recommendation that he not be neutered because it could trigger an episode of epilepsy that would kill him. LBAC had such disregard for his life, that he not only was misidentifed and his life put at risk because of their negligence; his care for the last 2 months has been outrageously poor. Fraggle is full of parasites. He has such severe chemical burns on his feet that he would barely walk on his pads. We would like to credit the people at Westminister Pet Sanctuary for being tenacious about locating this dog. For her efforts, Kelli at Westminister was spammed, harassed and called an animal killer by people from Friends of Long Beach Animals, Pnina Gersten MFCC, LBAC and several other "rescues". This is deplorable. We hope Fraggle and his new family have years of joy and fun together. Please take a moment to read his story:

It was such a relief talking to you and finding out more about our little man Peter(Fraggle) . On Oct. 7th for some reason I was compelled to go to the Long Beach Animal shelter. I had been thinking about getting a buddy for our little Lola a rescue dog we obtained 2 yrs ago. We can't imagine our lives without her. On that Saturday Oct.7th as I was wandering through the kennels with a lump in my throat looking at all the sad little faces. I stopped at one kennel and saw this sweet little face pretty much asking for my help. He stuck his paws out and wrapped them around my hands. It was love at first sight. His paws were extemely discolored and looked very painful. I filled out an application for adoption and was then able to visit with him. It appeared it was painful for him to walk but he was kissing me. My daughter came to meet him and he also loved her. Next we brought in Lola and they hit it off so the adoption was complete. We were not able to take him home as they were taking him to the vet to be neutered and we were advised we could pick him up at the vet on Monday. I asked about his history and I was told he was a stray picked up in Long Beach on 9/17. Asked about his feet and know one seen to have a clue. A kind volunteer said she would stay and bathe him and would have the vet at the shelter look at his feet I stayed until the vet looked at him and she thought they may be chemical burns. Possibly the kennels had been cleaned but not rinsed out and he stood in the chemicals. I can't believe no one ever noticed his condtion. When we picked him up from The Vet on 10/9 (whichis the same vet we use for our pets) we had the doctor examine Peter's feet and she was appalled as she had never seen anything like it. She gave us some anticeptic foot wash and atibiotics. My daughter has soaked his feet twice a day and cleaned them and they are now on the mend, we can actually see his paws are white and the skin between all four paws is healing. We took him back to the vet for a check up and she agreed his paws were much better but we continue to soak them. We also mentioned that he had a seisurethe first night home. She suggested to keep an eye on him and if it happenedagain to bring him in for test. She also did a fecal test and Peter checked positive for parasites so he is taking medication for that for 13 days. On Oct 21 I received a message on my recorder from the SPCA saying the dog I had adopted was from Noah's ark and may have seisures so I should check out their website. I did just as they suggeted and sure enough this little guy we adopted was on it and they were frantic about his whereabouts due to his condtion. Why was I told he was a stray?? and nothing said about seisures?? I contacted Alex who's # was on the site and told her I had Fraggle she was over joyed!!!. She gave me the background on him and said he had been missing since 8/24. I told the story I was given about him being a stray and brought in 9/17. I also told her about his condition and apparently he wasn't in that shape when he was taken from Noah's Ark. Just by speaking with her I knew she was a special person and has a big heart for disgarded pets and ones that are not so perfect. I told her we did not care about Peter (Fraggle) having seisures we loved him uncondtionally. I almost fell for all the bad publicity given to Noah's Ark but now I am begiining to see the light!!! I'm sure if she loved and knew so much about our little guy theother homeless animals at Noah's Ark were loved the same!!! Give them back!!!Anita

Chula is Free At Last!

Chula was assisted by AMRT to a foster and hopefully a new home soon. She is a rare Peruvian Orchid who was almost feral when Noah's Ark was able to rescue her from a backyard breeder. She and her "husband" and a litter of puppies came to Noah's Ark in very bad condition. Chula is five and being forced to live on cold cement was not good for her since she is a hairless breed.

Thank you to Carol at AMRT for working to get Chula out and on her way. People who are interested in adopting Chula can contact AMRT for further information about her. Here are her first photos on the outside!

Fraggle Update

This is a letter sent to the Mayor, the Governator, and shared with the Rescue Community at large. It shows how difficult it has become to try to help our animals!

...I must express how discouraged we are with the mis-information we are receiving about some of the special needs (epileptic) animals seized from Noah's Ark, and currently in the care of LBAC.I called today to ask specifically about a dog in cage 717, named Fraggle, an epileptic Chi about two years old.. and was told he was there.

In fact it was not Fraggle the epileptic Chi..another Chi just put in his cage.Half an hour later, someone else calls.."No Fraggle the Epileptic is in the Animal Hospital".Call the Animal Hospital..no epileptic Chi Fraggle there either..Where is this ONE EPILEPTIC CHI that I and NOW alot of other people across the Country and WORLD want to know.

I work worldwide with people and their epileptic animals, who care for these very special animals until their dying day..EVERYONE KNOWS HIS STORY NOW and are disgusted by the fact NO ONE will give us a straight answer on his fate.Is he alive or dead? Adopted or in a cage somewhere hidden from public viewing? (people have gone in LOOKING for him!!)This may only be "one epileptic dog in a shelter" that you think NO ONE CARES about, but that is not the case. There is now international attention to this case involving Fraggle (cage number 717..epileptic supposed to be on Potassium Bromide) and there is outrage.
People will be boycotting visiting your beautiful State and continue to spread the word about Fraggle the epileptic dog, until we get answers. Here is a picture of Fraggle, Mr Mayor and Governor..maybe you can go take a peek to see if you see him there..Heaven's knows NOBODY else can seem to find out his whereabouts or his fate. Please, take the time, show you care..find out what is going on! We have gone to alot of time and trouble trying to find out the fate of this dog..can you spare a few moments to do the same?

We have dedicated our LIVES to helping epileptic dogs..why will your State and Animal Control NOT allow us to help Fraggle??

It Shouldn't Be THIS Hard to Adopt!

Here's a recounting of an encounter TODAY at Pitchford Village. You would think the mandate there would be to get animals into homes, not try to talk people out of adopting!

Well you know how we were looking at the hairless doggie? It didn’t seem like the man that was showing us the dogs really wanted to help us.

First- we showed him the dog we wanted to take out[the hairless doggie] and ...he said that he didn’t think she was up for adopting. So he went to ask... then he came back and said that she was… but she was very mean and that she has already tried to bite a few of the staff members. Then he opened her kennel door, and took out his rope and tried to catch her…. No physical contact with the dog what so ever! He just swung the rope in her face trying to get it over her head, as the dog scurries to get away. He didn’t even dare to step inside the cage!

SOO, when he finally got her… he told us over and over to be very careful...And then he took her outside on the grass….. He bent down and started to cluck to the dog, and the poor [dog] is running in circles trying to get away! He walked her like as if she was going to rip his leg off!I felt like telling him…"Maybe if you weren’t so afraid of her, she wouldn’t be so afraid of you!" So [he] finally TOLD us that we didn’t want that dog… I felt like saying, YES WE DO!

So he walked her back to her kennel, like she was a monster.Omg! While she was out, he even had the nerve to say“She doesn’t even have one speck of pretty on her” Then my mom said, "Well, I guess the beauty is in the eye of the beholder." And the man just kind of snickered. You don’t talk negative about a dog that somebody is interested in,.. Unless you don’t want them adopted out. Kind of worries me!Also he said that most of the dogs where we were[ by your babies] were vicious. Go figure!

[Let me] tell you how the man got the rope off of her head!As I said before, he didn’t dare touch her….So, when he tried to take the rope off of her, he couldn’t.He got the broom, and used the handle to get the rope off!!!! Poor dog! As afraid as she already was, now there was a broom handle in her face and poking at her neck. Stupid! It took forever for him to take the rope off. Then after he got it off, he told us that he thinks a Chihuahua rescue was coming to get her. How can I believe that? I’m sorry but it’s just hard. My mom asked him what her breed was and he said “Mexican hairless Chihuahua” then we asked, then why is she so big.. And he said because Chihuahuas come in different sizes.

...on to the next doggie. The little old Chihuahua. The same man was helping us still…. He opened the gate, and like before didn’t touch the dog, or go in the cage.He just swung the rope in his face trying to catch him. Then the poor little guy, ran and hid under the blanket. So the man gave up. He said that he was too skidish.

He really helped us out ,huh!?

Help Us Find Fraggle

We were contacted by someone who had heard about Fraggle and wanted our sweet dog to have a wonderful home and life. She was unable to locate Fraggle at Pitchford Village. Please see if you can help us find Fraggle. There is a wonderful home and cushy life waiting for this very sweet animal.

Committe Members Visit Pitchford Village

On Saturday, committee members visited the animals at Pitchford Village. Only 4 NA animals are on the SPCA side for adoption. The visit caused quite a stir among the LBAC staff and the group was monitored very closely.

The visit brought up several pressing concerns: there are not enough pets at Pitchford to account for all the animals seized. Lt. Elliott could not disclose if there was an off site facility, but simply said all the animals at Pitchford were available for adoption. One relief is that Rocky was moved in with the stray cats out of the cold. He continues to have severe diarhea and is covered in poop. His indoor pen is quite small, but at least it is a little warmer. Anyone who can visit Rocky daily is encouraged to do so. You can see by the photos here and we can affirm for you, his health is declining rapidly. He needs to get out!!

Old Man is of great concern, he is said to be at Los Alamitos VCA for prostate problems. Old Man is a large hound whom we have not seen since August 23rd. There is a home waiting for him on a huge ranch. If you have time to call Los Alamitos VCA and ask about his condition, feel free to do so. We are nervous that this will be used as an excuse to kill him.

Our biggest concern was all the pets we did not see. All of the cats we didn't see. There are other animals being housed in the same "stray dogs" section with NA animals -- please don't be fooled into thinking that there are more animals there than are truly ours. Our dogs are in the 500 and 700 building. You have to really walk around to get to those housed in the far back. Others are in two sections that are chained off. We were reprimanded for going too close to the chain.

During the initial seizure, only 2 animals were reported to have been euthanized. Mr. Moore recently said that another 5 had died on their own. If these animals were in such poor condition, why are they just now being taken to the animal hospitals in the area to be given care. LBAC has had these animals in their care since August 23.

We are also concerned about the state of these animals care. There is poop and pee everywhere -- yes, it really does take a lot of work to take care of all those pets -- Noah's Ark volunteers did it EVERY day! This was during open business hours....imagine what the facility must look like when people arrive in the morning...about like Noah's Ark during the raid, maybe? Many of the animals are in total fear but gladly came to see us when they realized who was there to visit. We saw paws with extraordinarily long nails, we saw matts, we saw older animals who were cold since they live on cement flooring and stainless steel platforms. These are all conditions LBAC used to seized these animals. After so long with LBAC you would think they would be in better shape if the situation was really as LBAC said it was.

Please find the time to visit these animals, they need to know that they are important and loved...that they are not abandoned. Please encourage Wesley Moore to accept help from rescues and others who live out of state and want to adopt these animals. At the very least, the animals photos should be up online so that people can see them. Can we not work with other agencies to ensure that these pets can have homes that want them...even if they don't live in a 20 mile radius of Long Beach?! From a conversation with Lt. Elliott, it appears that Madeline Bernstein, President of the SPCALA is in charge of all the animals who will get out. Please contact Madeline at the SPCA (as we will be doing) to encourage her to let rescues come in NOW for the animals. Ask her to let out of state adopters have some leeway so that these animals can get out and on their way to homes. Of note -- we find it odd that Mr. Moore is being told what to do by Ms. Bernstein if the situation is really as Lt. Elliott has reported it to be.

We will post a list of the animals we have not seen shortly. You can join us in finding out, "WHERE are our pets?!"

Having One Eye is Not a Crime

No one is supermodel perfect! These two dogs are blind in one eye which makes them a bit more protective of their space. Karma is a beautiful chow, Willie is an adorable Chi-mix. Some people have been told they are aggressive and unadoptable. Please ask the shelter to reconsider. Both are adorable. Willie doesn't like men though, but he will run and jump into a woman he loves' arms! Karma loves a good snuggle but hates to be caged -- Karma gives wonderful chow kisses. Wouldn't that be nice to come home to everyday?

This is Money

Money is a delightful dalmation. He needs exercise, but hey we could all stand to use a few pounds - right? What better way than with a wonderful companion like Money. We are concerned because people have been told he is aggressive and unadoptable. He is sweet as the day is long. He walked out of Noah's Ark wagging his tail for the TV cameras. Give him a reason to wag his tail again!

Please Adopt!

If you have EVER thought about bringing an animal companion into your life, please consider doing so NOW. The animals from Noah's Ark are all wonderful, loving pets waiting to share their lives with you. The cats are wonderful feline friends. Our dogs, when they left our care, were sweet and easy-going.

We are particularly concerned about some pictures we recently received.

This is Fraggle. Fraggle has epilepsy brought on by stress. Fraggle is deathly afraid of men because he was abused severely by one; so, stressful men can bring on seizures. LBAC does not choose to recognize his condition. If you are able to adopt him, please consider giving this gentle dog a dignified end of life.

Dear Mayor Foster...

Long Beach always looks like a fun place to visit...on the postcards. With a high kill shelter that was promised two years ago to be a no-kill shelter and the roll back of a breeding ban -- animal lovers across the country should consider boycotting this city.

If you live locally,
let the Mayor, City Council members and Chamber of Commerce know that you intend to take your shopping dollars (and local sales tax revenue) elsewhere. Nearby communities offer all the same amenities you'll find in Long Beach. It may be a little out of your way, but those fuzzyfaces are worth it!

If you live further away,
let the City Council and The Mayor know that you don't intend to visit Long Beach if this case is demonstrative of how they treat animals in Long Beach. Let them know that you do not intend to ever recommend Long Beach as a destination to anyone. Let the Chamber of Commerce know that you will look for companies that manufactur or are headquartered out of Long Beach and you will not buy their products.

Ask them to step in proactively and demand that Long Beach Animal Control be called to account for all the animals -- not just vague numbers...a numbered list of all the animals with their impound numbers, microchip numbers, and current condition.

If you live in California,
email the CA Animal Control Director's Association and ask them have Wesley Moore account for the current state of affairs for the animals. info@cacda.org. Tell them you want an accounting back from them. You pay their salary through your tax dollars.

More Photos From the Inside

This is photo of Rocky taken this past week. Note he is covered in feces. Rocky has a registered owner who is being denied her animal. Instead he is forced to live in these conditions, ignored and cold. Rocky is very old and has poor eyesight. This is hardly the conditions he should be living in at a multi-million dollar facility with full-time paid staff to attend to his needs. At Noah's Ark, a 501C-3 with a mostly volunteer staff, Rocky was never left in this kind of deplorable state!

Rocky went to a smaller but warmer cage with the stray cats and then was pulled by a rescue group. A family had been set to adopt Rocky. We hope the rescue group will contact us so we can connect Rocky with a great home and get him out of foster care --- making room for another dog to get a chance at life.

Administrative Hearing Today

An administrative hearing was scheduled today. We were told it would simply be to review revoking Noah's Ark/Alex's business license. This is something of a kangaroo court since it is simply held in the basement of City Hall and presided over by an attorney and not a judge.

Alex chose to attend this hearing (although the outcome was a foregone conclusion) because she wanted to ensure that key elements did not end up in public record unchallenged -- such as the lie that LBAC/LBPD were given permission to enter the location (they were not, they entered without a search warrant.)

Apparently, LBAC and the Deputy City Attorney had planned to "try" the whole case to be presented by the city at this administrative hearing! This was not what Alex or Noah's Ark were notified that this hearing would review.

However, Alex was given the opportunity to question Lt. Quigley under oath. The transcripts of this hearing will clearly show ON THE RECORD that LBAC has been untruthful, that they have been inside the facility, that Officer Estrada was there just 10 days before and saw nothing that needed to be cited, and that Lt. Quigley knew that Alex had stepped down as Executive Director.

Since Alex was representing herself at this hearing (she didn't think she'd need an attorney to hear a case on revoking her business license), the Deputy City Attorney was required to give her much of the paperwork that Noah's Ark Justice Committee, Councilman De Long and the Mayor's office have been requesting. Ms. Meyers was not thrilled.

Currently, we are reviewing the "inventory" list and can already see that animals are missing or crossed out. We'll be getting answers as to what this means, but we are pretty sure we know already.

Please take a moment to send thoughts and love to Apple, the 3 year old Maltese who was incontinent but was just fine in a diaper. Apple has been lined out. Our adorable pocket pit bull is also lined out. There are many more in the list. There are also animals no one has seen in their visits -- Old Man aka Johnny Walker, the 10-ish Tick Hound...no one has seen him since the raid. It was a heartbreaking day on this front.

On a happier note, we were contacted by two happy new pet parents. Two of our older pets now have homes! No one has seen the cats. But we hope we are wrong and that we'll begin getting reports that they have been adopted too.

Conditions at the shelter are abyssmal for these pets. If you can afford the time and have the space in your home and heart, please help us retrieve these sweet animals from the shelter and get them to new homes.
